MOW ANGEL - HELP REQUEST DISCLAIMER

Before submitting the request form below, please take a moment to read the following disclaimer which outlines important information about the program and sets clear expectations for everyone involved. By submitting the form below, you acknowledge all of the following items.

1. Best Effort Disclaimer: The Mow Angel program is based on volunteer best efforts only and we do not make any guarantees that we can reliably or consistently clear the entirety of the property area(s) you request but we will do our absolute best. We will maintain grass cutting for as much lawn/area as we are able with the volunteers we have and the equipment they have at their disposal, which may vary between individual volunteers. If you find we are not adequately or reliably maintaining your lawn(s), you may need to supplement or replace our efforts with paid landscaping services as required.
2. Service Disclaimer: Our services are limited only to the cutting of lawn grass, bagging clippings, and trimming lawn edges around adjacent items (such as fences, sidewalks, driveways, etc.). Any other services a volunteer may offer to do is done at their individual discretion on a non-obligatory basis. We should not be expected to perform any gardening (including planting, watering, weeding, or otherwise maintaining of flowers or other decorative crop), trimming, addition, or removal of any large vegetation (including trees, bushes, hedges, etc.), or excavation (including digging, backfilling, or moving of any amount of earth material).
3. Response Disclaimer: We will maintain your lawn(s) by keeping grass cut to a reasonable length (not letting it grow to excess height) but we are not able to make any guarantees regarding minimum response times or frequency of visits. We will maintain your lawn(s) as consistently as we are able based on the number of volunteers we have available in your area and their time schedule availability. We do not offer any priority or VIP service abilities and there is no standardized basis by which we select which properties will be serviced in what order (this is at the individual volunteer's discretion).
4. Compensation Policy: Compensation is not expected nor required. If you would like to compensate the volunteer(s) of Kindness Rocks U.P. Michigan for their efforts, you can do so as you wish. The compensation you provide to an individual volunteer is theirs to keep and Kindness Rocks U.P. Michigan does not collect any portion of that compensation unless you specifically request we do so. Any such compensation you provide is not tax deductible. Volunteers are not permitted to explicitly ask for tips or compensation and we do ask that you report such instances if they occur.
5. Service Area Disclaimer: Currently, the Mow Angel program service area is restricted to only the areas that we have volunteers available to service properties. If we have no volunteers that are able to service your area, we may need to defer you until such volunteers are located. In these cases, we will keep your request on a holding list and, when at least one volunteer is located for your area, we will move your request to the active service list and inform you of this move. Similarly, if we lose all volunteers for your service area, we may need to move your service request to a holding list until new volunteers for your service area can be found. If this happens, we will notify you of this move as well.
6. Cancellation Policy: Should you wish to suspend the efforts of Kindness Rocks U.P. Michigan or any of its volunteers, you may do so at any time by contacting the Kindness Rocks U.P. Michigan staff by emailing mowangel@kindnessrocksup.com or sending us a message on our Facebook page. Any requests to suspend efforts will result in your property being removed from our service list for the remainder of the season and volunteers being informed that your property is no longer eligible for service. Kindness Rocks U.P. Michigan also reserves the ability to suspend the efforts of its volunteers at any time for any reason. If any such suspension is executed, you will be notified as soon as possible after that decision is made.
7. Animal Safety Policy: You agree to make sure any domestic animals are safely secured within your home or other appropriate building so that, when volunteer(s) perform lawn mowing work on your property area(s), they are not at risk of any injury that could be caused by any domestic animals. If our volunteer(s) find any domestic animals on or near any spaces needing to be mowed, they may, at their discretion, decide to return at a later time if required.
8. Property Access Acknowledgement: You agree and acknowledge that the volunteer(s) acting on behalf of Kindness Rocks U.P. Michigan have permission of the legal property owner, or individual(s) who are legally responsible for access control to the property, to gain access to the property for the purpose of maintaining lawn cutting and related activity on the property area(s) you list and that such access is limited to the minimum required spaces needed to mow all designated lawn spaces that you list. You further acknowledge that, should you wish to revoke this access, you may cancel the service at any time (see item 6).
9. Property Damage Liability Waiver: You acknowledge that Kindness Rocks U.P. Michigan and all volunteer(s) acting on behalf of the organization is held harmless and not liable for any amount of damage to property resulting from any lawn mowing on lawn space(s) that you list. You acknowledge that you are responsible for removing any items from the lawn space(s) that you want mowed (this is not the responsibility of the volunteer) and that any damage caused to items not removed and not readily visibly identifiable, the volunteer is not at fault except in cases of clearly demonstrable gross negligence. You further acknowledge that Kindness Rocks U.P. Michigan and all of its volunteers are not bonded nor insured. You also agree that, should you permit any Kindness Rocks U.P. Michigan volunteer access to and/or ability to use any landscaping equipment that, should any such equipment become damaged or otherwise inoperable, you will not, under any circumstances, hold the volunteer(s) or Kindness Rocks U.P. Michigan liable or responsible for any such damages except in cases of clearly demonstrable gross negligence or blatant misuse of any such equipment. Should any volunteer claim to or otherwise offer to fix, repair, replace, or compensate for the loss of use of any equipment, they do so as an individual and Kindness Rocks U.P. Michigan is not obligated to make good on any such claims. Your offering the usage of any landscaping equipment is not required nor expected but is appreciated should you choose to do so.
10. Personal Injury Waiver: You acknowledge that you will not, under any circumstances, hold Kindness Rocks U.P. Michigan nor any volunteer(s) acting on their behalf liable or responsible for any injury to you or anyone under your legal responsibility as the property owner, or responsible party thereto, caused by the inadequate or incomplete collection of grass clippings in any location in or around the property. You further agree that, should a Kindness Rocks U.P. Michigan volunteer be injured on your property while performing landscaping efforts, you are not liable nor responsible for any such injuries except in cases of clearly demonstrable gross negligence or clear intent to injure.
